1.  To implement the Resolutions of the General meeting and the Managing Committee through the Secretary.
  2.  To supervise work of the Secretary and to become responsible for the works done by him.
  3.  To accept all the mails (Dak) of the society and, after seeing the same, to issue necessary instructions to the Secretary to take action.
  4.  To deposit the entire cash on hand of the society in the Bank account at least once in a month.
  5.  To verify cash balance, verification of the property and securities of the society minimum once in each month and to make its note at the proper place in the record.
  6.  To get the defects stated in the Auditors verification note and of the Visitors notes be caused to be removed by the Secretary within one month from the receipt thereof and, to take steps to send its rectification report.
  7.  To provide all the information within time / timely as sought by Government departments / financial institutions.
  8.  To see that the works of the society is being carried out as per the byelaws and the objectives of the society and as per the laws and rules.
  9.  As authorised by the Managing Committee and staying with byelaws, to sign on behalf of the society on applications, receipts, agreements, writings, documents, tenders etc.

  1. Sir, I m a chairman of co-op hous. Service society in ahmedabad. Gujarat.
    Some 5 members covered society plantation land and make flooring and shade on that land .
    which is mentioned as plantation and soviety land in plan.
    Pls reply me ,how to clear that place and what action can be taken against that members. They want to go for legal against whole society .

  2. Sir, I am the President of Co. op Housing Society in Valsad. Our Treasurer & Joint Treasurer resigned due to some differences. It was intimated by them on committee WhatsApp group. In spite of our several request they refused to join, even did not attend the committee meeting. On WhatsApp group i recommended the name of joint secretary to take additional charge of Treasurer & one new member for joint Treasurer. Most of the member approved the same, but few members are opposing saying it is not valid. Meantime we have issued several cheques to vendors & salary to staffs. Now some of the members say it is a fraud, you can issue cheque without the signature of treasurer. The other signatory was joint secratary who was given additional charge of treasurer. Please guide

    1. 1. Once a committee member resign, they automatically get removed from the committee. It does not require any approval from the committee.
      2. Once there is any vacancy (Chairman / Secretary / Treasurer), the committee can fill the vacancy in the committee meeting and minute it.
      3. Any vacancy of committee member, it needs to be filled as an election process if committee period is less than 2.5 years and by co opting in case committee is more than 2.5 years old.
      4. Signatory and mode of operation can be decided by committee. There is no such requirement in byelaw or act that treasurer should be a signatory.
      5. Byelaw of the society only defines the role of Chairman, Secretary and committee. Role of treasurer or any other role created by the committee, will depend on what function is allocated to them.
      6. All decisions should be taken in a physical meeting and not on whatsapp. Even resignation from the committee should be taken physically.

  3. I am the chairman of Housing Service Society for last 2 years. There were few problems due to irregular maintenance of members in the society. We used to keep all our accounts and also kept the key of the office with us. On the day when society’s agm was to be held, when we had to go to the hospital, they gathered everyone and instigated us. The next day they broke the lock of the office and stole all the books. Due to their negligence, the police does not register a complaint. We have informed the district registrar in writing. They have also filed a police complaint against us.

  4. Sir, I’m living in a co-operative housing society since past 15 years. As my house was in bad condition, I renovated it in 2020-21. Since, I had not taken pre approval from AMC, so to regularize the construction, I have submitted an application under GRUDA act for Impact fee to AMC. For this I also need an NOC from the chairman of our housing society. The chairman of the society is not having good terms with me and he is asking for approved layout plan from me. I want to know whether this comes under his purview or just he is trying to delay it to not give me NOC. Please suggest what are the other options I have if he denies giving me an NOC.
